Your Financial Privacy Rights (Gramm-Leach-Bliley Act)
As a licensed mortgage broker, First Look Home Loans is a financial institution under the federal Gramm-Leach-Bliley Act (GLBA). The following describes how we treat the nonpublic personal information (“NPI”) you share with us when you inquire about or apply for a mortgage. This section supplements — and does not replace — the practices described elsewhere in this policy.
What we mean by nonpublic personal information. NPI is personally identifiable financial information that is not publicly available — for example, the income, employment, asset, and account details you provide on an application, the Social Security number you submit through our secure portal, and information we receive from consumer reporting agencies such as your credit report. It does not include information that is lawfully made publicly available.
How we use your NPI. We use your nonpublic personal information only to evaluate, process, underwrite, and arrange the mortgage financing you request, to communicate with you about your application and loan, and to satisfy our legal, regulatory, and recordkeeping obligations. We do not sell your nonpublic personal information.
How and why we share your NPI. To arrange and process your loan, we share nonpublic personal information with nonaffiliated third parties only as permitted by law — including the categories of recipients described in “Who We Share Your Information With” above (such as wholesale lenders and investors, credit reporting agencies, title companies, appraisers, and other settlement service providers), and with government or regulatory authorities where required. These disclosures fall within the GLBA exceptions that permit sharing necessary to provide and service the financial product you have requested.
Your right to limit sharing. Federal law gives consumers the right to limit some — but not all — sharing of their nonpublic personal information. Because we share your NPI only as necessary to process and service the loan you requested and as otherwise permitted or required by law, our sharing is not subject to a consumer opt-out.
How we protect your NPI. Consistent with the GLBA Safeguards Rule, we maintain administrative, technical, and physical safeguards designed to protect your nonpublic personal information against unauthorized access, use, or disclosure. Sensitive information such as your Social Security number is collected only through our secure application portal, access to your information is limited to personnel and service providers who need it to perform their work, and we require the third parties who receive your information to protect it.
Former applicants and customers. We continue to apply these privacy and safeguarding practices to your nonpublic personal information even after your application is complete or you are no longer an active customer, for as long as we retain that information.
